Terms and Conditions (T&C)

1. General
These Terms and Conditions (T&C) apply to all business relationships between the customer and Rene Gayer – MBS-TRAINING (hereinafter referred to as "Provider"). Deviating agreements or terms require the express written consent of the Provider. The Provider is based in Austria.
2. Offers and Prices
2.1. All offers from the Provider are non-binding. A contract is only established upon written confirmation by the Provider.
2.2. All prices are in euros, excluding VAT, and apply only to the specific order.
2.3. Prices for online core courses, subscription models, and single course purchases are as published on the website. Additional costs, such as contract fees, travel expenses, or accommodation, will be billed separately.
2.4. The Provider reserves the right to make price changes with a prior notice period of three months.
3. Online Core Courses, Subscription Models, and Single Purchases
3.1. Online Core Courses and Subscription Models
The offered online core courses and all content provided under subscription models remain the property of the Provider. The customer acquires a limited, non-transferable right to use the content. Access to course content under a subscription is granted for the agreed subscription period. Access automatically ends when the subscription expires.
3.2. Single Purchases of Courses
When purchasing individual courses, the customer acquires an indefinite right to access the respective course as long as the platform remains available.
3.2.1. The Provider reserves the right to remove or deactivate courses from the platform at any time. In such cases, the customer’s right to access the course will terminate.
3.2.2. If the platform is permanently discontinued, the customer's right to access all purchased courses will also cease. There is no claim for alternative provision of the content.
3.2.3. The customer will be informed in advance about significant changes, such as the deactivation of a course or discontinuation of the platform.3.3.
General Usage Terms
Sharing access credentials or distributing content to third parties is prohibited and may result in legal action.
4. Payment Terms
4.1. Invoices from the Provider are due immediately upon receipt without any deductions.
4.2. For subscriptions, billing occurs in advance for the selected billing cycle (e.g., monthly or annually).
4.3. In the event of late payment, interest of 4% per annum above the base rate will be charged.
4.4. Delivered goods or activated content remain the property of the Provider until full payment is made.
5. Retention of Ownership
5.1. All course content, materials, and other services remain the intellectual property of the Provider.
5.2. The Provider reserves the right to suspend access to course content in the event of payment default.
6. Warranty and Liability
6.1. The Provider ensures the proper provision of online courses in accordance with technical standards.
6.2. The Provider assumes no liability for technical issues caused by the customer’s devices or internet connection.
6.3. The Provider's liability for negligence is limited to the invoice amount.
7. Right of Withdrawal and Cancellation Policy
7.1. For distance contracts, customers have a withdrawal right of 14 days, provided that access to online courses has not yet been activated.
7.2. Once content has been activated, the withdrawal right expires under § 18 Abs. 1 Z 11 FAGG (Austrian Distance and Off-Premises Contracts Act).
7.3. For subscriptions, customers may cancel at any time at the end of the current billing period. Payments already made will not be refunded.
8. Cancellations and Schedule Changes
8.1. The Provider reserves the right to cancel or postpone events or online courses due to unforeseen circumstances. Fees already paid will be refunded.
8.2. Any further claims for damages are excluded.
9. Use and Access to Course Content
9.1. Access to online courses and platform content is provided via the Provider’s website.
The usage terms available at Nutzungsbedingungen apply in addition to these T&C.
9.2. Sharing access credentials or distributing content to third parties is prohibited.
10. Data Protection and Confidentiality
10.1. The Provider processes personal data in accordance with the General Data Protection Regulation (GDPR). Further details can be found in the privacy policy on the website.
10.2. The customer agrees to treat all content provided by the Provider as confidential and not share it with third parties.
11. Final Provisions
11.1. Should any provision of these T&C be invalid, the remaining provisions remain unaffected.
11.2. Austrian law applies exclusively. The competent court at the Provider's place of business has jurisdiction.
